MY BUILDING PERMIT APPLICATION WAS DENIED AND I WANT TO REQUEST A VARIANCE THROUGH THE ZONING BOARD OF APPEALS. WHAT IS THE PROCESS? AND IS THIS VARIANCE GUARANTEED?
You may apply to be heard before the Zoning Board of Appeals through the Planning and Zoning Office. Applications are available for download from the Planning and Zoning Forms Page. The ZBA is composed of not more than 7 members. In order to receive a variance you must obtain a majority vote granting your variance. The burden is upon the applicant to prosecute his/her case before the ZBA. Typically, a hardship is required in order to receive consideration by the Board.
